Terms & Conditions

1. Accuracy of Information

The donor certifies that all details provided regarding the donated property—whether a boat, yacht, motor vehicle, or other asset—are truthful, accurate, and complete. This includes but is not limited to make, model, year, mileage or hours, overall condition, and any known defects or damage.

2. Ownership and Authority

The donor confirms they are either the sole legal owner of the asset being donated or possess full legal authority to act on behalf of the owner. Any and all existing liens, loans, encumbrances, or third-party interests related to the property have been fully disclosed in writing to The Benevolence Foundation (BENFO).

3. Transfer of Title

The donor agrees to transfer legal title and ownership of the donated asset to BENFO upon acceptance of the donation. The donor will execute all required documents and cooperate fully to ensure the lawful and timely completion of the title transfer process.

4. Disposition of Donated Assets

The donor understands and agrees that all donated property becomes the exclusive property of BENFO upon transfer. BENFO reserves the right to sell, assign, auction, recycle, or otherwise use or dispose of the asset in any manner that supports its charitable mission. No restrictions will be placed on the use or disposition of the donated property.

5. “As-Is” Condition

All donations are accepted “as is,” without any express or implied warranties or guarantees of condition, function, or value. BENFO makes no commitment regarding the use, resale price, or charitable impact of any individual donation.

6. Tax Deductibility

BENFO is a registered 501(c)(3) charitable organization. The donor is responsible for obtaining a qualified appraisal, if applicable, and for complying with all IRS regulations to claim a tax deduction for the donation. BENFO will issue a written acknowledgment letter as required by law, but does not provide tax, legal, or accounting advice.

7. Jurisdiction and Dispute Resolution

This agreement shall be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes arising out of or relating to this donation shall be resolved through binding arbitration conducted on an individual basis, and not as part of a class or collective action. Both parties waive the right to a trial by jury.

8. Acknowledgment

By submitting the donation through BENFO.org, the donor affirms that they have read, understood, and agree to be bound by these Donation Terms and Conditions.
